The Compliance Monitoring and Enforcement (CME) Task Force within the ASTSWMO Hazardous Waste Subcommittee and the Sustainable Materials Management (SMM) Task Force within the ASTSWMO Materials Management Subcommittee collaborated to produce a series of three fact sheets on emerging wastes from renewable energy sources: lithium-ion batteries with a focus on electric vehicle batteries; photovoltaic modules; and wind turbine blades. The fact sheets are intended to be living documents to be periodically updated with new information.
More presentations may be posted in the near future.
Waste disposal capacity is a current and long-term issue facing both the hazardous waste (HW) and materials management (MM) programs. The HW incinerator backlog has highlighted ramifications for generators and treatment, disposal and storage facilities (TSDFs) that are not incinerators, and broad issues such as the supply chain and worker shortages. On the MM side, solid waste capacity shortfalls due to the closure of disposal facilities has implications not only in the State where the disposal facility is located but also where the waste is transported. Management of PFAS-contaminated and Superfund cleanup wastes and siting considerations are among the issues affecting capacity over the long term. The session will discuss current and future issues and invite attendees to share their experiences and challenges with HW and MM capacity.

Extended Producer Responsibility legislation is one of many policy tools employed to divert difficult-to-manage materials from landfills. As of March 2022, 34 States and Territories (States) have an EPR law covering at least one product, with two jurisdictions - California and Maine- each having laws covering nine different items. Many States considering expanding their own legislative EPR portfolios have looked to other jurisdictions for guidance. Directly mirroring programs from State-to-State has benefits and detriments. Moreover, some States have sought to implement programs that operationally mirror EPR without requiring legislation. This session will cover lessons learned from retrofitting legislative EPR models from State-to-State and how some States have proceeded with an EPR concept without statutory changes.
