Redevelopment Successes at Petroleum Underground Storage Tanks Sites Webpage: (January 2017)
Through the years, State programs have evolved to assist our community leaders and developers in decision-making processes related to redevelopment of LUST sites. The LUST Task Force developed this webpage to present information on redevelopment stories that have occurred in States across the country. Updates to this webpage will be prepared periodically. Guidance for Understanding Petroleum Storage Tank Bankruptcy (January 2017)
The State Fund-Financial Responsibility Task Force developed this guidance to encourage dialogue between regulators and their legal counsel when regulated facilities are subject to bankruptcy proceedings. This is an introduction to legal terms and concepts related to bankruptcy to facilitate communication and enhance understanding. It also presents an overview of the process, milestones, and potential actions and decisions that may need to be taken with the guidance and assistance of legal counsel.

The circumstances of each case will guide the regulator on how to best proceed in order to continue the corrective action at release sites that are in bankruptcy proceedings. Regulators are encouraged to be cognizant of key deadlines that are critical in the bankruptcy process. In addition, it is important to understand the roles, authorities, and limitations of the bankruptcy laws, as well as the intersection of State laws related to the environment, so as to proceed in the best interest of environmental protection.

Compatibility Considerations for Underground Storage Tank Systems (Updated May 2016)
The Emerging Fuels Task Force developed this report as an update and replacement to the 2013 ASTSWMO Alternative Fuels Workgroup’s Compatibility of UST Systems with Biofuels report. This document serves as a resource for State and Territorial underground storage tank (UST) program staff, UST owners and operators, equipment manufacturers, and contractors and consultants for the evaluation of equipment compatibility pursuant with EPA’s compatibility requirement (40 CFR 280.32) specifically when storing motor fuels. The document includes information product and operational compatibility, properties of biofuel blends, and considerations for the storage of biofuel blends. Also included are several policy and technical resources, a template for creating a compatibility evaluation checklist for State programs, and a compilation of case summaries from several States.

An Analysis of UST System Infrastructure in Select States (October 2015)
Note: In 2014, ASTSWMO formed the Aging Tanks Workgroup to examine issues related to aging UST systems and the potential impacts to owners, operators, and State UST programs. The Workgroup’s objective was to analyze whether aging UST infrastructure poses a higher risk of leaks, thus creating higher risks for State tank funds and private insurers and, ultimately, higher costs for tank owners/operators. The final report includes an analysis of UST system data from eight participating States as well as information on potential risk factors of fuel leaks, State policies and initiatives for mitigating risks of aging tanks, and State fund and financial insurance considerations.

Lead Scavengers Survey Report (August 2014)
In 2013, the Tanks Subcommittee's LUST Task Force requested information from all States and Territories to determine what activites the tanks programs are taking to identify and remediate the lead scavengers 1,2-dibromoethane (EDB) and 1,2-dichloroethane (1,2 DCA). Thirty-five States responded and the Task Force found that there continues to be great variation from State to State on how lead scavenger issues are addressed, which is summarized in this report.

Lust Trust Fund Fact Sheet: (August 2014)
The Tanks Subcommittee developed the fact sheet to summarize information, guidance, and budget information specific to the LUST Trust Fund. The Trust Fund provides federal funding to support the U.S. EPA's, States', Territories, and Tribal LUST prevention and response programs.

NOTE: A typo/ error in the original release stated that the LUST Trust Fund is financed by a "0.01 tax". The LUST Trust Fund is financed by a 0.1 cent tax (10x $0.01). The Fact Sheet has been updated to correct this error.

Development and Implementation of State Tanks Core Programs (June 2014)
The Tanks Subcommittee and the Core Report Workgroup developed this document to provide a detailed picture on the costs of operating and maintaining the State underground storage tank programs. ASTSWMO requested that all States provide data on the dollars spent on personnel, outreach, supplies, inspections, cleanup oversight, and other necessary costs associated with operating the programs. The data was compiled and analyzed to show how different States are utilizing both federal and State funds, and how expected budget cuts could impact the State UST programs.

Leaking Underground Storage Tanks

State Approaches to Managing Institutional Controls and Ensuring Long-Term Protectiveness at LUST Sites (May 2015)
The document is the result of recent discussions at ASTSWMO meetings and an information request sent to all States, Territories, and the District of Columbia (States) that focused on how State tanks programs manage institutional controls and ensure long-term protectiveness of remedies at LUST sites. Included in the report are policies, tools, and practices from the 35 States that responded to the request for information, and brief summaries where applicable.

Compendium of Emergency Response Actions at Underground Storage Tank Sites – Version 2 (July 2014)
The LUST Task Force developed this compendium to present information on emergency response actions that have occurred in States across the country. UST programs across the country require reporting, initial abatement measures, and free product removal activities to occur immediately upon discovery of a release to protect human health and the environment. Updates to this compendium will be prepared periodically.

LUST TF Green Remediation Fact Sheet (August 2010)
This fact sheet is intended to be used by State and Territorial regulators who oversee the investigation and cleanup of petroleum releases at LUST sites and summarizes background information on green remediation techniques applied at the retail gasoline station scale.

Information for Evaluating UST Financial Responsibility Options ( December 2002)
This document was prepared as a reference tool to assist State tank program managers in understanding the issues that arise in insurance coverage of leaking underground storage tanks. No reader should infer that the document advocates or discourages the use of commercial insurance in the program. Some States have developed fund-based approaches to cleanup assistance, and others are using alternative approaches to provide coverage in accordance with Federal financial assurance requirements. We believe that each State is best equipped to make such choices, and ASTSWMO's task is to provide the information necessary to make the decisions. This reference tool is intended to provide all State program managers with a consolidated source of information.

UST Common Compliance Violations Reports (Updated September 2016)
The UST Task Force solicited information from all States in an effort to determine which violations are most often encountered during UST compliance inspections and other verification activities. The intent of this report is to provide a national perspective with regard to which UST violations are discovered in greatest frequency and may require additional attention. The data could impact where States allocate resources and how they perform onsite UST inspections, where the regulated community can best allocate their resources to improve compliance, and future decisions regarding the long-term direction of State and federal programs.

The UST Task Force plans to update these reports on a biennial basis to identify any trends across the UST programs.

Operator Training Resource Guide and Spreadsheet (March 2012 Update)
The ASTSWMO UST Task Force has developed the Operator Training Resource Guide as an information tool for States and Territories, as well as operators. It contains core information on each State UST operator training program such as the method States choose to conduct operator training, limitations imposed, how training programs and trainers are approved, and the name, phone number, and program website for each State/Territory operator training program. The UST Task Force will conduct periodic updates in order to keep the Guide up to date with new or revised information.

Peer Match Trip Report Compendium
This document provides a summary of Peer Match trips taken by ASTSWMO members from State Tanks programs.

The Association of State and Territorial Solid Waste Management Officials (ASTSWMO) has limited funding available to allow States and Territories (States) to share experiences and technologies related to Brownfields, CERCLA, Federal Facilities, Hazardous Waste, Solid Waste, and Tanks program management. This "peer match" funding supports the ability for one or two State managers or staff seeking assistance to travel to another State for two to three days to exchange information, applications, experiences, technologies, and reports on programmatic approaches of particular interest to the participating States. ASTSWMO will reimburse State staff seeking assistance for travel expenses incurred on the peer match trip.
