ASTSWMO is pleased to invite State and Territorial (State) Brownfields, Federal Facilities, Hazardous Waste, Superfund, Tanks (UST & State Fund-FR), and Materials Management managers, as well as EPA Headquarters and Regional staff, DOD officials, and other invited guests to the October 30 – 31, 2019 ASTSWMO Annual Meeting in Washington, DC. Due to limitations on hotel meeting space capacity and accommodations availability, priority attendance will be given to our members, federal officials, and invited guests.

ASTSWMO will feature the theme of “States Leading The Way” in light of ASTSWMO’s 45th Anniversary. ASTSWMO was founded on October 22, 1974 in Atlanta, GA. The theme will showcase how States are changing their programs through regulations and legislative efforts to address environmental protection

The presentation will focus on how Colorado has changed their Tanks program by authorizing their Petroleum Storage Tank Fund to be used for prevention purposes in addition to cleanup. This change allows them to address aging tanks issues as well as legislation that created their Petroleum Brownfield Fund that is now targeting the redevelopment of sites with EV charging station infrastructure.

This presentation will provide an overview on how States are addressing severalsustainable materials management issues such as food waste, the impact of China Sword and the banning of various single-use plastics.

This session will focus on the trial use of the Risk Management Method (RMM) for Military Munitions Response Program (MMRP) developed by the U.S. Army Corps of Engineers. Dr. Kari Meier will lead a presentation and discussion about the RMM that will include answering common questions that have been raised by States about RMM. This session follows several online and in-person trainings about RMM
The Definition of Solid Waste, Generator Improvements, and Pharmaceuticals Rules present opportunities to move the hazardous waste program forward. States must adopt some parts of these rules or the whole rule (in the case of the pharmaceutical rule). Come discuss the quirks for State adoption of each of these rules. In this session, EPA representatives will lead a discussion regarding State adoption of each of these rules and encourages States to share their experiences and questions. We will begin the session with a reflection on the accomplishments of RCRA and the ASTSMWO Hazardous Waste Programs over the past 40 years.
The session will begin with an overview of the current national picture of domestic recycling markets in light of China’s import restrictions on certain recyclables, also known as China Sword. It will then turn to a presentation by members of ASTSWMO’s Sustainable Materials Management (SMM) Task Force of the results of the Task Force’s outreach to ASTSWMO members during 2019 about how State and Territories have responded to China Sword. Market development, public education and outreach will be highlighted.

According to EPA’s most recent semi-annual performance report (FY 2019 Mid-Year), there are roughly 64,000 LUST sites nationally that have not reached cleanup-completed status. ASTSWMO is interested in gaining a better understanding of how many of those sites are not being cleaned up because there is no viable responsible party (RP) or funding/funding mechanism to move the site forward. ASTSWMO will summarize information collected through a recent information request to all States and lead a discussion on strategies States are implementing to address orphan tanks sites.

Small and rural communities often face many challenges when it comes to sustainable Brownfield redevelopment and community revitalization. Though the projects may be smaller, they often make monumental impacts for America’s rural and small places. This session is meant to share and discuss how to bring expertise and resources to areas that may lack capacity to fully handle a brownfield redevelopment project but want to succeed in preserving and remaking their economies and communities. Presenters will include representatives from city, State, and national programs who have made great strides in assisting small communities in revitalizing their brownfield properties, local economy, and community pride.

Invited speakers will provide a summary of their environmental management programs. Following brief presentations, ASTSWMO will facilitate a discussion on successes and current challenges at cleanup sites on federal lands and identify strategies for improving coordination between States and federal agencies.

This session will feature two innovations by the NC Division of Waste Management (DWM)/Hazardous Waste Section. Any balance of time will focus on emerging waste streams, including hemp and electric car batteries.
• Streamlining the NC Hazardous Waste Billing using RCRAInfo and the Exchange Network: In FY 2019, the Hazardous Waste Section migrated to a new automated exchange with the EPA database RCRAInfo and CRM, a billing and communication platform. The new system has increased data accuracy, increased generators’ access to information, sped up the communication process, and presents a variety of opportunities that the Section can use to communicate with NC State Hazardous Waste Generators.
• Well Permit Decision Tool: As the use of GIS technologies continue to grow, it isthe strategy of DWM to leverage more of its enterprise data through this technology to provide better, more efficient access to its data inventory. In 2019, the DEQ deployed the Well Permit Decision Tool, a web-based application that will leverage some of these datasets to assist local health departments in locating known sources of contamination and what information exists about each source.

The need to reduce waste and environmental impacts from plastic bags has prompted many municipalities, counties, and more recently, States, to implement bag programs. This session will focus on bag programs adopted by a city, a county, and a State, highlighting the conditions that led to its passage, components of the program, any implementation issues/successes, and measurable benefits.

The ASTSWMO State Fund-Financial Responsibility Task Force will lead presentations and discussions on a number of topics, including the Annual State Fund Survey and changing and transitioning financial assurance mechanisms in States. Attendees will also have the opportunity to introduce specific questions from their programs.

States and EPA are increasingly responding to releases of PFAS into the environment. Both the States of Vermont and Wisconsin will share their experiences of working in communities during large PFAS investigations and responses. They will share what worked well, lessons learned and future plans. EPA Region 6 will talk about risk communication during an Emergency Response action in Texas.

The session will begin with presentations on RCRA predictive analytics and an EPA Region 2 targeting tool. EPA is concluding a three-year initiative that has tested a predictive analytic model designed to identify facilities that are most likely to have violations. EPA will explain the purpose of the model, the preliminary results, and future State participation in the project. The RCRA Target Selection Platform was designed by EPA Region 2 and is used by both EPA and the Region 2 States to target and signup for RCRA Hazardous Waste inspections. The application uses numerous data sources to display summary information for all potential targets and facilitates prioritization. These presentations will be followed by updates on the RCRA Air Initiative and Smart Tools training.

We are now one year past the final implementation deadline set forth in the 2015 Federal UST Regulations. NonSPA States and Territories, along with some with SPA, are now implementing all new regulations. This session will provide an open forum for sharing feedback on how your program is doing, a platform for questions that have come up during the implementation of your rules, and a way to share your successes and problems with other States and Territories that are just now or will be getting in to implementation. Be prepared to share your problems, successes, and anything else that may be beneficial to those already implementing or are just entering that phase.

Leadership from ASTSWMO’s State Federal Coordination Focus Group will moderate a discussion on the implementation of land use controls (LUCs) at federal facilities, which is the subject of an issues paper the Focus Group began drafting this fall. Following a brief overview of the paper’s outline attendees will be invited to ask questions and offer suggestions on the Focus Group’s work, introduce successes and challenges encountered when managing LUCs at federal facilities, and ask questions for the purpose of sharing policy information and overcoming challenges.

Participants are encouraged to discuss their experiences, concerns, challenges, and any questions that they may have on how to ensure a successful enforcement program. If you have innovative ideas or you are having an obstacle that EPA or another State or Territory may be able to help you with this is your opportunity to share them!
